RESOLUTION OF CLARIFICATION OF THE

1997 VERMONT LAND USE PLAN

 

1. This resolution directs the Town Board and the Planning Commission to use the following paragraph defining the status of grandfathered parcels:

It is also recognized that there are a number of substandard parcels in the delineated agricultural areas of the plan map, which are smaller that 35 acres required for A-1 Exclusive Agricultural Zoning. There is provision in the zoning ordinance which allows one house per such parcel, where it was vacant at the time of Exclusive Ag Zoning adoption. This "grandfather clause" allows one house per such parcel with change to appropriate zoning when needed. Agricultural Policy, 1a, page 5, allows for splitting such parcels if they are 20 acres or larger and the site criteria of policy 1b, page 5, are met. The original paragraph (3) is located on page 15 of the 1997 Land Use Plan.

2. This resolution directs the Town Board and the Plan Commission to use the following definition of open space which is found on page 3, paragraph 1 "open space includes wetlands, woodlands, croplands, meadows, pastures, and other undeveloped land."

3. This resolution defines that the second to the last sentence of page 13 in the 1997 Land Use Plan which ends with "is preferred" to mean that the 1 through 5 rating of the four "Consideration Goals" on page 13 is optional and advisory. The total numerical score on page 13 cannot therefore be used by itself to deny a potential building site.
