2.01 WISCONSIN UNIFORM DWELLING CODE ADOPTED. Pursuant to ss101.65, Wisconsin Statutes, the Town Board hereby establishes a building code for the construction of new one and two-family dwellings and for remodeling of existing such dwellings by adoption and incorporating in this ordinance by reference the following Wisconsin Administration Code Chapters:

Chapters IND 20 (Administration and Enforcement), IND 21 (Construction

Standards), IND 23 (Heating, Ventilating and Air Conditioning), IND 24

(Electrical Standards, IND 24 Plumbing and Potable Water Standards)

adopted and effective June 1, 1980, and all amendments thereto; and Chapter

IND 22 (Energy Conservation Standards) as adopted and effective December l,

1978, and all amendments thereto.

2.02 BUILDING INSPECTOR. The Building Inspector of the Town of Vermont as appointed by the Town Board and as certified by the Department of Industry, Labor and Human Relations, is hereby authorized and directed to administer and enforce all of the provisions of the Uniform Dwelling Code.

2.03 BUILDING PERMITS.

  1. Requirements for Obtaining a Building Permit. No person shall build or assemble or cause to be built or assembled, any building with a market value of more than One Thousand Dollars ($1000) in the Town without obtaining a building permit from the Town Board prior to the start of construction.
  2. Application for a Building Permit. (revised 2/12/01, 12/9/02) To apply for a building permit, the owner of the land where the building is to be constructed will present the Town Building Inspector with an approved county Zoning Permit, and a site plan which demonstrates compliance with all county requirements for building permits and compliance with the Town Land Use Plan’s requirements that:
    1. no new buildings will occupy land of agriculture significance, except as outlined in the Land Use Plan Section 4, Goal 2, Paragraph 2a
    2. no new buildings shall disturb any slopes over twenty percent (20%) unless effective erosion control measures are installed to limit soil loss from the construction site to no more than 7.5 tons per acre.
    3. nor disturb any land within 1,000 feet of any stream, wetland or other surface water resource unless the soil loss from the construction site is limited to no more than 7.5 tons per acre.
    4. Only single family dwellings will be permitted for non-farm homes.
  3. Farm Accessory Building. A farm accessory building may be located as best suits the farm operation for which it is to be used. A farm accessory building is defined as any building which is used by a farm operator who derives a substantial part of his/her livelihood from the farm operation in which the building is to be used, which is to be constructed on a parcel of at least thirty five (35) acres and zoned exclusive A1-Ag by county zoning. If a person wishes to build a farm accessory building on a parcel of less than thirty five (35) acres, the Town Board will review this on a case by case basis and may allow the building to be located where it best suits the farm operation.
  4. Building Permit and Inspection Fees. The Town Board shall set the building permit and inspection fees for buildings requiring a permit through a resolution of the Board, and will review those fees yearly.

2.035 HOLDING TANKS. (9/12/95) Except where a variance is granted in accordance with the standards and procedures provided in ss7.08, holding tanks for new construction shall not be approved. Each new building must have suitable area, as required by Ch. ILHR 83, Wis. Adm. Code, for a private sewage system that incorporates soil disposal. When use of a holding tank becomes the only available alternative for the disposal of sanitary liquid waste for an existing building, a holding tank shall be permitted as a replacement system provided it meets the requirements established for use of holding tanks for newly developed properties under Ch. ILHR 83, Wis. Adm. Code.

2.04 PENALTIES AND ENFORCEMENT. The Town Board may enforce the provisions of this Ordinance by means of the withholding of building permits, the imposition of fines and forfeitures and injunction actions, according to Wis. Stat Ch. 62.23(9).

2.05 SEVERABILITY. If any section, clause, provision or portion of this ordinance or Wisconsin Administrative Code Chapters IND 20, 21, 22, 23, 24, or 25 is adjudged unconstitutional or invalid by a court of competent jurisdiction the remaining provisions shall not be affected thereby.
