6.01 LICENSE REQUIRED. Pursuant to 60.10 and 60.23(10) and 175.20, Wis. Stats., every person who conducts and operates in the Town any short term amusement or recreation use, activity or business which is open to the public for use and enjoyment and for which a fee is charged or invokes a gathering of more than 250 persons on land which is not properly zoned for such activity or such activity is not allowed by conditional use permit shall obtain an Amusement-Recreation Event License from the Town prior to engaging in or advertising to engage in such use, activity, business or event.

6.02 AMUSEMENT AND RECREATION ACTIVITY DEFINED. The following types of amusement and recreation activities, businesses and operations are considered amusement or recreation subject to the provisions of this ordinance:

  1. Amusement and theme parks.
  2. Campgrounds/camping
  3. Dance halls
  4. Cross country skiing
  5. Festivals
  6. Motor vehicle races, including snowmobile races
  7. Outdoor fairs or festivals
  8. Outdoor and indoor music concerts
  9. Public exhibitions or exhibits
  10. Rodeos
  11. Road rallies (auto, motorcycle, or bicycle)
  12. Religious retreats
  13. Political rallies
  14. Athletic events/competitions

The above list is not exclusive. Other outdoor and indoor amusements and recreations similar to the above shall be considered included in the types of amusements and recreation subject to licensing under this ordinance.

6.03 APPLICATION, FEE, ISSUANCE

  1. Application. Application for an Amusement-Recreation Event License shall be made to the Town Clerk and shall contain the following information:
    1. Name, address and telephone number of applicant.
    2. Address and description of premises to be licensed or permitted.
    3. Description of uses, activities, business or operation to occur on premises.
    4. Date(s) of activities or events.
    5. Proposed hours of operation.
    6. Description and location of any temporary building or structures to be constructed on premises.
    7. Telephone number of premises.
    8. Description of parking lots or areas and access routes for vehicular traffic.
    9. Description and proposed location of any amplification equipment to be used in connection with the amusement or recreation.
    10. Description of any security needs in connection with the amusement or recreation and a description of how security needs will be met.
    11. Description of any amusement rides, amusement attractions or amusement structures in connection with the amusement or recreation and number or date of approval or inspection by Wisconsin Department of Industry, Labor and Human Relations pursuant to Ch. ILHR 34, Wis. Admin. Code.
    12. Name, age, address and telephone number of on-site manager or other person in charge of premises to be licensed with full authority in all matters relating to operation of amusement or recreation to be conducted on licensed premises.
    13. Proposed method of disposing of human waste and other waste material generated by activity, recreation and amusement operation.
  2. Application Fee. The application fee for an Amusement-Recreation Event License shall be established annually on or before July 1 of each year by the Town Board based on the cost of processing the application and administering requirement of this ordinance. The initial fee of twenty-five dollars ($25) shall be paid to the Town Clerk at the time of application.
  3. License Fee. If a license is issued to the applicant, the application fee shall be credited against the license fee. The license fee for an Amusement-Recreation Event License shall be established annually on or before July 1 of each year by the Town Board based on the cost of administering the license. The initial license fee of twenty-five dollars ($25) shall be paid to the Town Clerk at the time of license issuance.
  4. Issuance. Amusement-Recreation Event Licenses shall be issued by the Town Clerk if approved by the Town Board after review of the application.

6.04 DURATION OF LICENSE. An Amusement-Recreation Event License shall be issued for the period specified in the application or for the period July 1 of one year until June 30 of the succeeding year, whichever is shorter.

6.05 INSPECTION AND INVESTIGATION OF APPLICATION. No Amusement-Recreation Event License shall be issued to any applicant unless the Town Building Inspection Supervisor and Town Board Chairman have inspected the premises where the amusement or recreation activity will be carried on and notified the Town Board in writing that it meets all required state, federal, county and municipal fire and safety codes for the activity to be conducted thereon or therein. Any food service and liquor license shall be obtained prior to issuance of license. If any nonconformity or violation is found, no license shall be issued to the applicant unless the inspecting official has re-inspected the premises and notified the Town Board that such deficiency has be rectified.

6.06 RESTRICTION ON ISSUANCE OF LICENSE: GROUNDS FOR NONRENEWAL. No person shall be issued or re-issued an Amusement-Recreation Event License who has failed to properly and fully complete and submit to the Town Clerk the application form as developed and provided by the Town; who, subject to 111.335, Wis. Stat., has been charged and convicted of the violation of a state law or local ordinance; who has failed to arrange or allow inspection of the premises as required by s. 6.05.

6.07 SUSPENSION OR REVOCATION OF LICENSE. The Town Board may suspend for not more than thirty (30) days or revoke the amusement license of any licensee upon the determination after public hearing conducted in accordance with s. 125.12, Wis. Stats., for failure to maintain the premises of activity as defined by the application submitted in accordance with s. 6.03.
